- Introduction:
The General Treasury of Social Security (TGSS) is the organism in charge of the collection of all the resources of the Social Security, both in voluntary period and in executive way, being able to enforce the debtor's assets. To this end, it is empowered by the Law to seize its assets and sell them at public auction in order, with the result of the alienation, to collect the outstanding debt and settle the debt sought.
The auctions are the last phase of the administrative enforcement procedure and by means of them the collection bodies of the General Treasury of the Social Security try to put on the market the assets previously seized from the debtors of the Social Security.
The product obtained in the auctions is destined to pay off the pending debt of the hard-pressed, and in the case of having surplus it is delivered to them.
From the point of view of the debtors, the possibility that they have to paralyze the procedure, at any stage prior to the adjudication of the assets, through the payment of the debt they maintain with Social Security, makes many of the lots committed in auctions they are withdrawn for this reason
- Property seized for auctions:
The General Treasury of the Social Security alienates, through public auction, farms (rustic and urban), vehicles, boats, machinery of various types, office furniture, office equipment and all kinds of movable or immovable property seized from the debtors of the Seg -Social.
- Advertising of the executive auctions of seized assets:
The General Treasury of the Social Security, as a consequence of the enforcement procedures that it follows against its debtors, is obliged to announce the auctions it holds for the sale of seized assets and , in this way, enable any interested person to attend and bid on them.
- Who can participate?
With the exception of the staff of the Executive Collection Unit, the appraisers, the custodians of the assets and the officials directly involved in the enforcement procedure, any person, by themselves or through a representative, who has the capacity to act in accordance with the law and is not subject to the exceptions and incompatibilities established by law.
- Requirements:
To be able to participate in the auctions it is necessary: To be
properly identified, simply by displaying it in the public act or by including in the sealed envelope a copy of the National Identity Document or, in the case of foreigners, the passport, the travel document or another document that proves your identity. Likewise, accreditation of the representation with which, where appropriate, it is acted.
Consign 25% of the starting price (type of auction) of the property for which you wish to bid, by certified check, endorsed or made by the drawee and on behalf of the General Treasury of Social Security, which will accompany the bid that it is carried out in a sealed envelope, or 30% of said price if the position is verbal in the public act of holding the auction.
In the justifying receipt of the consignment or deposit it is necessary to record, for the purposes of possible awards, the hour and minute in which said delivery was made, as well as the corresponding order number.
